Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Nowly. By creating an account or using Nowly, you agree to these Terms. If you do not agree, do not use the service.
1. Who we are
Nowly (“Nowly”, “we”, “us”, “our”) is an online platform that lets a business owner turn their business into a branded, shareable booking mini-app through a short questionnaire, and manage bookings from a dashboard.

2. Definitions
- Owner / you: the person or business that creates a Nowly account and builds a mini-app.
- Mini-app: the booking app you build and publish with Nowly, reachable at a Nowly link (e.g. nowly.online/your-name).
- End customer: a person who visits or books through your mini-app.
3. Eligibility & your account
- You must be at least 18 years old and able to enter into a binding contract.
- You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account.
- You must provide accurate details. If you use Nowly on behalf of a business, you confirm you are authorized to bind it to these Terms.
- Notify us promptly if you believe your account has been accessed without your permission.
4. The service: free to build, paid to grow
Building and previewing a mini-app is free. Certain features, such as publishing, a custom domain, and AI-assisted editing, are part of a paid plan. We may change which features are free or paid; if we materially reduce a feature you have already paid for, section 7 (Subscriptions) applies.
We may improve, change, or discontinue parts of the service. Where we reasonably can, we will give notice of material changes.
5. Acceptable use
You agree not to use Nowly to:
- break any applicable law, or offer goods or services you are not legally allowed to offer;
- infringe anyone's intellectual-property, privacy, or other rights;
- upload malware, attempt to breach security, scrape, or overload the service;
- impersonate others or misrepresent your business;
- send unsolicited commercial messages in breach of applicable anti-spam law.
We may suspend or remove content or accounts that breach these Terms or the law.
6. Your content and your end customers
You keep ownership of the content you add (business name, logo, text, images, services). You grant Nowly a worldwide, non-exclusive, royalty-free license to host, display, and process that content solely to operate and provide the service to you.
When your end customers book through your mini-app, you, not Nowly, decide why and how their booking data is used. In data-protection terms you are the controller of that data and Nowly is your processor, handling it on your instructions to run the mini-app. Our Privacy Policy describes this split. You are responsible for having a lawful basis and your own privacy notice for the personal data you collect from your end customers.
7. Subscriptions, billing & cancellation
- Paid plans are billed in advance on a recurring basis (monthly or yearly) through our payment processor, and renew automatically until cancelled. Prices are shown before you subscribe.
- Prices are exclusive of any taxes unless stated otherwise; where we are required to charge tax, it is added at checkout.
- You can turn off renewal at any time from your account. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where the law requires otherwise, payments already made are non-refundable.
- Where the law where you live gives you a statutory cancellation or “cooling-off” right for online purchases, that right applies and nothing in these Terms limits it.

8. Intellectual property
Nowly, its software, design, and brand are owned by us or our licensors and are protected by law. These Terms do not transfer any of our intellectual property to you beyond the limited right to use the service while these Terms are in effect.
9. Third-party services
Nowly relies on third-party providers to run, including cloud hosting, authentication, database, and payment providers, and (on the platform, with your consent) analytics. How they handle data is described in our Privacy Policy. Your use of features that rely on them may also be subject to their own terms.
10. Availability, suspension & termination
We aim to keep Nowly available but do not guarantee uninterrupted or error-free service. We may suspend or terminate access for breach of these Terms, legal reasons, or risk to the service. You may stop using Nowly and close your account at any time; on closure, published mini-apps stop being served.
11. Disclaimers & limitation of liability
To the maximum extent permitted by law, Nowly is provided “as is” and “as available” without warranties of any kind. Nowly is a tool for building and running your mini-app; we are not a party to any transaction between you and your end customers, and we are not responsible for your bookings, services, or content.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill. Our total liability arising from or relating to the service is limited to the amount you paid us for the service in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold Nowly harmless from claims arising out of your content, your mini-app, your dealings with end customers, or your breach of these Terms or the law.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and change the “last updated” date; for material changes we will give reasonable notice. Continuing to use Nowly after changes take effect means you accept them.
14. Governing law & disputes
These Terms, and any dispute arising out of or relating to them or to your use of Nowly, are governed by the laws applicable where we operate the service, without regard to conflict-of-law rules. This does not affect any mandatory consumer-protection rights you have under the law of your country of residence, which continue to apply.
